Why Semax needs a prescription
It is a drug built from a pituitary hormone
Semax is a seven-amino-acid peptide, sequence Met-Glu-His-Phe-Pro-Gly-Pro. The first four are positions 4 to 7 of adrenocorticotropic hormone (ACTH), with a Pro-Gly-Pro tail added for stability, and it is described as devoid of ACTH's cortisol-raising activity. It was developed at the Institute of Molecular Genetics of the Russian Academy of Sciences and has been used in Russian neurology for stroke and chronic cerebrovascular disease since the 1990s. A compound with that history, given by injection, is a drug under US law.
The statute that makes it prescription-only
Section 503(b) of the Federal Food, Drug, and Cosmetic Act defines a prescription drug as one that is not safe for use except under the supervision of a licensed practitioner, including because of the method of its use. An injectable peptide meets that test, may be dispensed only on a prescription, and the rule attaches to the person dispensing it.
Why a compounded version can exist without FDA approval
Section 503A of the same Act exempts a drug compounded for an identified individual patient on a valid prescription, by a licensed pharmacist in a state-licensed pharmacy, from the approval requirement. Why it is not a scheduling question
Semax is not a controlled substance and does not appear on the DEA's schedules. The prescription requirement and the pharmacy rules are the controls that apply to it, so a seller that skips them is operating outside the only regulation there is.

An advisory vote is a recommendation, not a listing. The FDA issues its own determination after weighing the vote, the public docket and its scientific review. Even a final listing would not make Semax an FDA-approved drug: the bulks list governs what a pharmacy may compound from, and compounded medications are never approved as finished products. What the FDA's review said about the evidence
The FDA's July 2026 evaluation excluded the Russian clinical studies because complete English translations were not supplied, not because they were judged poor. On the material it could read, it found insufficient evidence of effectiveness for the nominated uses, said the substance was not well characterised in the nominations, and said immunogenicity could not be ruled out. It also found no published pharmacokinetic work on subcutaneous Semax.

What "research use only" means legally
A regulation, 21 CFR 201.125, exempts a drug from carrying directions for use when it is sold for laboratory research not involving clinical use. A person injecting the contents is the clinical use that exemption excludes. A second regulation, 21 CFR 201.128, says intended use is shown by what the seller says and advertises, so a site publishing Semax "focus protocols" next to a "not for human consumption" label is describing a human use.

What the evidence shows, honestly
A prescription makes Semax lawful. It does not make the evidence stronger. There are no randomised, placebo-controlled trials of Semax published in English-language, peer-reviewed journals.
